ÇİĞDEM KUNDURA DEFECTIVE GOODS, WARRANTY AND PRODUCT INSPECTION POLICY

1. SCOPE

This Policy explains the inspection process to be applied in the event of a claim regarding manufacturing or material-related defects in products sold by Çiğdem Kundura and the consumer's legal rights.

This Policy does not limit the consumer's rights arising from the Law on the Protection of the Consumer No. 6502 and other relevant legislation.

2. DEFECTIVE GOODS

A product may be considered defective if;

  1. It does not possess the features reported during the order or described on the product page,
  2. It does not fulfill its intended use,
  3. It does not possess the quality and performance that similar products should have,
  4. It is delivered incomplete, incorrect, damaged, or different from what was ordered,
  5. It does not have the characteristics specified in advertisements, labels, or descriptions

Each application is examined individually, taking into account the nature of the product, the method of use, the duration of use, and the reported problem.

3. CONSUMER'S OPTIONAL RIGHTS

In the event that the product is understood to be defective, the consumer may exercise one of the following rights:

  1. Withdrawing from the contract and requesting a refund by notifying that they are ready to return the product,
  2. Requesting a discount from the sale price in proportion to the defect while keeping the product,
  3. Requesting free repair, provided it does not require excessive cost and all expenses are covered by the other party,
  4. Requesting the replacement of the product with a non-defective equivalent, if possible.

In cases where fulfilling the right chosen by the consumer is impossible or disproportionate, other optional rights stipulated in the legislation shall apply.

4. PROOF AND LIABILITY PERIOD

Defects that appear within six months from the date of delivery are presumed to have existed at the time of delivery. The burden of proving otherwise lies with the seller.

Unless a longer period is stipulated in the law or the contract, liability for defective goods is subject to a two-year statute of limitations from the date of delivery of the product to the consumer.

The statute of limitations provisions do not apply if the defect was concealed through gross negligence or fraud.

5. PRODUCTS WITH WARRANTY CERTIFICATES

For products for which a warranty certificate is issued by the manufacturer or importer, the warranty conditions provided with the product shall apply additionally.

The fact that a product is not subject to a warranty certificate does not eliminate the consumer's legal rights regarding defective goods.

The invoice, order record, and payment receipt may be used to verify the purchase transaction.

6. APPLICATION FOR INSPECTION

Customers who believe that there is a defect or manufacturing error in the product may apply through the following channels:

Sharing the order number, product information, description of the problem, and, if possible, a photo or video showing the problem in the application will accelerate the inspection.

Requesting a photo or video does not eliminate the consumer's legal right to apply.

7. SHIPPING THE PRODUCT

If a physical inspection is required following the preliminary assessment, the customer will be notified of the contracted shipping company and the free shipping code.

For applications involving defective, faulty, incorrect, or incomplete products, the necessary shipping costs will not be charged to the customer.

The product must be packaged in a way that it will not be damaged during transport.

8. INSPECTION PROCESS

The product is examined taking into account the reported problem, usage conditions, material properties, and the general condition of the product.

If necessary, technical opinions may be obtained from the manufacturer, importer, or supplier.

The customer is informed of the inspection result in writing or via a permanent data storage device.

Requests for free repair or replacement with a non-defective equivalent are concluded within the maximum periods stipulated by law.

9. SITUATIONS THAT MAY ARISE FROM USE

The following situations may be considered as resulting from use or maintenance based on the result of the specific inspection:

  1. Use of the product contrary to its intended purpose,
  2. Forcing the product to be used despite an incorrect size or mold preference,
  3. Use on wet, muddy, or unsuitable surfaces contrary to the product type,
  4. Washing in a washing machine or cleaning with unsuitable chemicals,
  5. Drying directly on a heat source,
  6. Unauthorized repair, painting, gluing, or alteration,
  7. Damage caused by friction, impact, cutting, burning, or pets,
  8. Normal sole wear, creasing, discoloration, or deformation due to use,
  9. Storing the product in a damp, airless, or unsuitable environment for a long time.

The presence of these situations is not an automatic reason for rejection. Whether or not the product is defective is determined as a result of the specific inspection.

10. PRODUCT USE RECOMMENDATIONS

It is recommended that shoes be used on surfaces suitable for their intended use, aired regularly, and cleaned with appropriate care products.

Wet products should be dried at room temperature, without exposing them directly to the sun or a heat source.

Care methods suitable for the material should be used for synthetic leather, genuine leather, textile, and suede products.

11. CONCLUSION AND OBJECTION

If it is determined as a result of the inspection that the product is defective, the consumer's optional right arising from the legislation is fulfilled.

In case the application is rejected, the reason for rejection is notified to the customer.

The customer may apply to the consumer arbitration committee, consumer court, or other authorized bodies against the inspection result.
